DISTANCE SALES AGREEMENT (TÜRKİYE)

This Distance Sales Agreement (“Agreement”) is concluded electronically between the SELLER and the BUYER (consumer) in accordance with applicable Turkish consumer legislation, including Law No. 6502 and the Regulation on Distance Contracts.

QUICK RETURN & WITHDRAWAL INSTRUCTIONS (Summary)

  • Withdrawal period: 14 days from delivery (goods).

  • How to withdraw: Email us at info@maisonturkuaz.com with your order number and a clear withdrawal request.

  • Return deadline: Send the goods back within 10 days after your withdrawal notice (unless we offer pickup).

  • Return carriers: PTT or Yurtiçi Kargo (designated carriers).

1.2 BUYER (Consumer)

The person who places an order through the website (“BUYER”). BUYER information is the information entered during checkout (name, delivery address, e-mail, phone).

2) SUBJECT AND SCOPE

This Agreement governs the sale and delivery of physical goods ordered by BUYER through the website and sets out the Parties’ rights and obligations.

3) PRE-CONTRACT INFORMATION

Before placing an order and before any payment obligation arises, BUYER is provided with pre-contract information on the website, including (as applicable): product features, total price (taxes included), shipping costs, payment methods, delivery time, right of withdrawal rules, return carriers/procedure, complaint channels, and dispute application methods.

By completing checkout, BUYER confirms they have reviewed and accepted the pre-contract information and this Agreement.

4) ORDER DETAILS, PRICE, PAYMENT

The details shown to BUYER at checkout form an integral part of this Agreement, including:

  • Product name(s), quantity, unit price(s)

  • VAT/taxes

  • Shipping/delivery fee(s), if any

  • Discount(s), if any

  • Total payable amount

  • Payment method used

5) DELIVERY

5.1 Delivery Address

Goods are delivered to the address entered by BUYER at checkout.

5.2 Delivery Time

SELLER delivers within the timeframe shown on the website/checkout and, for goods, no later than 30 days from the date the order is received by SELLER, unless a different period is legally permitted and clearly communicated to BUYER.

5.3 Stock / Impossibility

If an item becomes unavailable or delivery becomes impossible, SELLER informs BUYER and applies the legally required remedies (such as cancellation and refund).

6) RIGHT OF WITHDRAWAL (Cooling-Off Right)

6.1 Withdrawal Period (14 days)

BUYER may withdraw from this Agreement within 14 days without giving a reason and without penalty.

For goods, the 14-day period starts on the day the goods are received by:

  • BUYER, or

  • a third party designated by BUYER (other than the carrier).

BUYER may also withdraw before delivery.

6.2 How to Use the Right of Withdrawal

To withdraw, BUYER must send a clear notice to SELLER in writing or via a durable medium (e.g., e-mail).

7) RETURN OF GOODS AFTER WITHDRAWAL

Unless SELLER offers to collect the goods, BUYER must return the goods within 10 days from the date the withdrawal notice is sent to SELLER.

When returning, please ensure:

  • The goods are complete with accessories (if any),

  • Protected packaging is used to prevent damage in transit,

  • Order number / proof of purchase is included where possible.

(Changes/deterioration arising only from normal inspection/use consistent with the product’s nature may not affect the withdrawal right. However, damage due to inadequate packaging during return shipment may affect rights and claims.)

8) REFUNDS

8.1 Refund Time

SELLER refunds payments collected from BUYER within 14 days from the date SELLER receives BUYER’s withdrawal notice.

8.2 Refund Method

Refunds are made using the same payment method used by BUYER (where technically possible) and without charging a fee to BUYER.

8.3 Refund Hold (If Applicable)

Where legally permitted, SELLER may withhold the refund until:

  • the returned goods are received, or

  • BUYER provides proof of return shipment (whichever occurs first).

9) RETURN SHIPPING / DESIGNATED CARRIERS

Return shipping cost policy (withdrawals):

  • If BUYER returns goods using PTT or Yurtiçi Kargo according to SELLER’s instructions, return shipping costs will be handled as required by applicable Turkish consumer law and the pre-contract information provided at checkout.

  • If BUYER uses a different carrier without SELLER’s instruction/approval, BUYER may be responsible for the shipping cost, except where mandatory consumer rules require otherwise.

  • If the designated carrier has no branch in BUYER’s location, SELLER will arrange a reasonable alternative in line with legal requirements.

10) PRODUCTS NOT ELIGIBLE FOR WITHDRAWAL (Non-Returnable)

BUYER acknowledges that the right of withdrawal does not apply to:

  1. Custom-made / made-to-order products produced according to BUYER’s personal specifications.

(If SELLER adds any other legally exempt categories in the future, they will be clearly listed in the pre-contract information provided at checkout.)

11) DEFECTIVE / WRONG / MISSING ITEMS

If BUYER receives defective goods, incorrect goods, or missing items, BUYER should contact SELLER promptly at info@maisonturkuaz.com with the order number and (if possible) photos. BUYER’s statutory rights for defective goods remain reserved.

13) DISPUTE RESOLUTION

In case of disputes, BUYER may apply to the relevant Consumer Arbitration Committee or Consumer Courtaccording to jurisdiction and monetary thresholds in Türkiye. Where required by law, mediation may be a prerequisite before filing a lawsuit.

14) GOVERNING LAW

This Agreement is governed by the laws of the Republic of Türkiye. Mandatory Turkish consumer rules apply.

15) ACCEPTANCE & EFFECTIVE DATE

This Agreement is deemed accepted when BUYER completes the order electronically (checkout) and becomes effective at that time.
